Implementation of the EU Whistleblower Directive in Germany What is the Whistleblower Protection Act?
The Whistleblower Protection Act (HinSchG) is intended to serve as an early warning system for companies and as a protective shield for employees.
The Whistleblower Protection Act regulates the protection of all persons who, in connection with their professional activities or in the course of preparing for such activities, have obtained information about violations and report or disclose this information to the reporting offices designated under the Whistleblower Protection Act.
What violations can be reported under the Whistleblower Protection Act?
Violations punishable by criminal penalties or fines, provided that the violated provision serves to protect life, limb, or health, or to protect the rights of employees or their representative bodies, and violations of a range of legal provisions under EU, federal, and state law, such as those concerning environmental protection, traffic safety, product safety, data protection, or antitrust law (§2 HinSchG).
Where can whistleblowers submit reports?
Reports can be submitted internally in writing to meldestelle@moebel-starke.de or in person to Ms. Christin Mutschink.
An external reporting office is established by the state. The main state reporting office is located at the Federal Office of Justice.
